Conference to summarize the work in 2023 and implement the work program in 2024 of the Copyright Office of Vietnam

On the morning of December 25, 2023, the Copyright Office of Vietnam held a conference to review the 2023 work and implement the 2024 work program. Attending and directing the conference, Comrade Trinh Thi Thuy, Deputy Minister of Culture, Sports and Tourism. Attending the Conference were leaders and all officers, civil servants, employees and employees of the Copyright Office of Vietnam.

On behalf of the leader of the Copyright Office of Vietnam, Director General Tran Hoang presented the outstanding results that the Copyright Office of Vietnam has implemented in 2023 and directions and tasks in 2024. Right from the beginning of the year, the leaders of the Copyright Office of Vietnam and all officials, civil servants and employees of the Copyright Office of Vietnam have been united, focused, drastic and made efforts to overcome difficulties to organize the implementation of the tasks in the work program approved by the Ministry of Culture,  Sports and Tourism approval and other work according to the functions, duties and powers of the Bureau.

Regarding the work of advising on building and perfecting institutions and policies on copyright and related rights

The Copyright Office of Vietnam has researched, developed and advised the Ministry of Culture, Sports and Tourism to submit to the Government for promulgation the Government’s Decree No. 17/2023/ND-CP dated April 26, 2023 detailing a number of articles and measures to implement the Law on Intellectual Property on copyright,  relevant rights. The Decree takes effect from the date of signing.

Circular No. 08/2023/TT-BVHTTDL dated 02/06/2023 on the regulation of samples in copyright registration activities and related rights was born

In 2023, the Department has consulted on developing and submitting to the Government a draft Decree replacing Decree No. 131/2013/ND-CP stipulating administrative sanctions on copyright and related rights.

Along with that, there is  the implementation of Project 88/QD-TTg 2017 on strengthening the capacity to manage and effectively enforce the law on copyright protection, rights related to 2020, orientation to 2025 and the Intellectual Property Strategy to 2030.

In addition, the Copyright Office of Vietnam also contributes to the development of other legal documents and schemes.

  About the management of the cultural industry

In implementing the strategy: In 2023,  the Department has developed a draft report to submit to the Head of the Ministry for approval to the Government and the Prime Minister according to regulations. The report has fully reflected and assessed the achieved results, outlined difficulties, problems, causes, solutions and proposals to overcome in order to develop cultural industries in the coming time. The Copyright Office of Vietnam is the agency in charge and develops the draft strategy and submits it to the Ministry’s leaders for consideration and approval.

The Department successfully organized the National Conference on the Development of Vietnamese Cultural Industries on December 22, 2023 at the Government Headquarters.

In 2023, the Department has monitored and coordinated with the People’s Committee of Quang Ninh province and relevant units  in developing and completing the content of the “Pilot Project on cultural industry development in Quang Ninh province”.Formulate the scheme of the National Brand Building and Creativity Award  for Cultural Industries and give suggestions and coordinate in the development of relevant programs, plans and projects.

Regarding  international integration and cooperation in the field of copyright and related rights

Currently, the Copyright Office of Vietnam is participating in negotiations on trade agreements such as  the ASEAN-Canada Free Trade Agreement (ACAFTA), the Comprehensive Economic Partnership Agreement between Vietnam and the United Arab Emirates (CEPA Agreement), the Free Trade Agreement between Vietnam and EFTA.

The Copyright Office of Vietnam always works actively in cooperation with international organizations WIPO, UNDP, KCOPA. In 2023, the Department will participate in international meetings organized by WIPO, in collaboration with UNDP to organize conferences and seminars to propagate and disseminate the basic contents of the Marrakesh Treaty and legal provisions on copyright and related rights of Vietnam.

At the same time, the Department always actively participates in cooperation activities with countries in ASEAN, China, Korea and the US: participating in meetings, seminars, conferences, forums, business trips, working sessions, etc. on copyright, related rights and cultural industry. Especially this year, the Department has advised the Ministry of Culture, Sports and Tourism in signing a Memorandum of Cooperation in the field of copyright and related rights between Vietnam and China on December 12, 2023.

Regarding information, propaganda and dissemination of legal education on copyright, related rights and cultural industry

It can be said that immediately after basically completing the institution and policy on copyright law and related rights, the  Copyright Office of Vietnam has drastically and actively engaged in communication, propagation, dissemination and legal education on copyright, related rights, institutionalization of copyright law, etc  delving into people’s lives in order to raise awareness and legal awareness about copyright and related rights for many subjects.

2023 can be said to be a “booming” year of communication, propaganda and dissemination of legal education on copyright, related rights and the cultural industry. In the past year, the Department has organized 20 events and activities on propaganda and dissemination of legal education on copyright and related rights nationwide for more than 3000 attendees, in various forms  such as seminars, seminars, conferences, seminars and special training in 2023,  The Copyright Office of Vietnam has successfully organized a series of events in response to World Intellectual Property Day 26/4, World Book and Copyright Day 23/4 nationwide.

In parallel with the organization of activities and events, in order to communicate widely on television, the internet … The Department has coordinated with the following units: Vietnam National Assembly Television; Vietnam Television, Voice of Vietnam, News Television, Hanoi Radio and Television and some media units: Culture Newspaper, Fatherland Electronic Newspaper, VOV Electronic Newspaper to implement the communication plan on cultural industry,  copyright, related rights in 2023. In addition, Vietnam Copyright Website is a place to gather information, legal knowledge about copyright and related rights that people look up daily.

Regarding the processing of dossiers, issuance of Certificates of copyright registration, related rights and implementation of administrative procedures for recognition of consulting organizations.

The Department has received dossiers of registration of copyright and related rights in accordance with the order and procedures prescribed by law, diversified forms to facilitate citizens: Online Public Service Portal and Electronic One-Stop of the Ministry of Culture, Sports and Tourism,  integration with the National Public Service Portal; public postal services; Receive directly at 3 locations: Hanoi, Ho Chi Minh City and Da Nang City.

From January 1, 2023 to December 13, 2023, the Department has issued 10,390 Certificates of registration of copyright and related rights (of which, the number of dossiers for registration of copyright and related rights  through the public postal service  is 1,500  dossiers; the number of dossiers of registration of copyright and related rights directly submitted is 5,276 dossiers; the number of copyright registration dossiers,  relevant rights submitted by citizens through the Online Public Service Portal and the Ministry of Culture, Sports and Tourism: 4,414 applications).

In 2023, the Department has received 43 applications for copyright and related rights service consultancy, of which 36 applications have been approved.

Regarding the settlement of complaints and denunciations and professional responses on copyright and related rights

Resolving complaints and denunciations and professional replies is one of the important tasks in protecting copyright and related rights, in 2023, the Copyright Office of Vietnam has received, accepted and resolved complaints and petitions, reflecting 16 cases: completing the settlement of 13 cases,  is dealing with 3 cases .

Cases are resolved in accordance with legal provisions, procedures, and consensus of related parties.

Regarding the management of collective management organizations of copyright and related rights

In order to implement the management of  collective management organizations of copyright and related rights with high efficiency, on October 5, 2023, the Department has organized a collective representative conference for collective management organizations on copyright and related rights; instruct the Vietnam Center for Music Copyright Protection (VCPMC) to continue completing the dossier of application for approval of the royalty schedule.

To urge and synthesize data on the operation of collective management organizations of copyright and related rights in service of the state management of the culture, sports and tourism sectors.

Regarding copyright assessment activities, related rights

The conclusion of assessment of copyright and related rights is one of the sources of evidence for competent agencies to handle and settle cases in accordance with law. Over the past year, the Department has consulted, guided and given professional opinions within its competence on the procedures for requesting copyright assessment and related rights for organizations and individuals. The Department has received, processed dossiers and conducted an assessment of 09 cases upon request.

At the same time, the Department has developed a draft Circular stipulating criteria, quality standards, economic-technical norms and guiding the assessment of information and communication on copyright and related rights in service of state management; organize consultations with related units.

After listening to the report summarizing the work in 2023 and implementing the 2024 work program of the Copyright Office of Vietnam and comments of representatives of the Department’s leaders and officials in the Department; Deputy Minister Trinh Thi Thuy shared: “This is a very difficult and wide field, however, over the past year, the Department has successfully completed the assigned tasks, showing the bravery and ingenuity of professional workers. I acknowledge, commend and appreciate the sense of responsibility, dynamism, creativity,  efforts, drastic, effective and achievements that all cadres, civil servants, employees and employees of the Copyright Office of Vietnam have achieved in 2023.”

Directing at the Closing Conference, the Deputy Minister asked the Copyright Office of Vietnam to continue to innovate strongly, demonstrating the aspiration to develop in the new era, in 2023 the Copyright Office of Vietnam needs to focus on key tasks:

First, continue to focus on building institutions and policies on copyright and related rights; The law amending and supplementing a number of articles of the IP Law was passed by the National Assembly on June 16, 2022 and takes effect from January 1, 2023. Therefore, after the IP Law comes into effect, it is necessary to implement the law, issue decrees and circulars to bring the law into life.

Second, after the National Conference on the Development of Cultural Industries, it is necessary to focus on developing a Resolution on tasks and solutions for the development of cultural industries. Accelerate work to implement  the pilot project on cultural industry development in Quang Ninh province. It is necessary to be more proactive and drastic in coordinating with relevant units inside, outside the Ministry, sectors and localities to promote the implementation of the Strategy for the development of cultural industries in Vietnam to 2020 with a vision to 2030 in order to implement and implement Decision No. 1755/QD-TTg more effectively.

Third, continue to promote international cooperation, participate in many international seminars and seminars… to learn and draw on professional work management experiences. Actively review legal provisions in international commitments and treaties that Vietnam has been and will accede to. Since then, affirming Vietnam’s position in the common playground in the international arena.

Fourth, coordinate with relevant ministries and sectors through coordination programs and regulations. Since then, communication and education have raised awareness about copyright in order to reduce the rate of copyright infringement and related rights.

Fifth, focus on strengthening the contingent of cadres, civil servants and employees of the Department, planning to train staff in professional and foreign languages; continue to build internal solidarity, the Party, Trade Union, Youth Union, Lawyers’ Association of the Department will grow stronger and develop in the coming time.
