Press Release The conference collecting comments on the draft Decree replacing the Government’s Decree No. 131/2013/ND-CP dated October 16, 2013 stipulating penalties for administrative violations of copyright and related rights in Phu Yen, dated July 20, 2023

In 2013, the Government issued Decree No. 131/2013/ND-CP replacing Decree No. 47/2009/ND-CP; Decree No. 131/2013/ND-CP is amended and supplemented in Decree No. 28/2017/ND-CP and Decree 129/2021/ND-CP. After 10 years of implementation, the legal corridor on copyright and related rights has changed. In Resolution No. 50/NQ-CP dated 08/4/2023 of the Government assigned the Ministry of Culture, Sports and Tourism to preside over the development of a Decree on sanctioning administrative violations of copyright and related rights (replacing Decree No. 131/2013/ND-CP), ensuring uniform application of the provisions of law, effectively implement the Law amending and supplementing a number of articles of the Law on Intellectual Property in 2022 on copyright and related rights and ensure that violations occur with sanctions for reasonable and effective penalties.
Implementing the assigned tasks, the Ministry of Culture, Sports and Tourism has issued Decision No. 1207/QD-BVHTTDL dated May 11, 2023 promulgating the Plan to develop a Decree stipulating penalties for administrative violations of copyright and related rights, with specific work contents, Following the progress, it is expected to complete the dossier to submit to the Government in the fourth quarter of 2023.
On July 20, 2023, the Copyright Office in collaboration with Phu Yen Department of Culture, Sports and Tourism will organize a conference to collect comments on the draft Decree replacing the Government’s Decree No. 131/2013/ND-CP dated October 16, 2013 stipulating penalties for administrative violations of copyright, related rights in Tuy Hoa City, Phu Yen Province.

In addition to units under the Ministry of Culture, Sports and Tourism, members of the Drafting Committee, the Editorial Team to develop the Draft Decree, the conference was also attended by representatives of the Departments of Culture, Sports and Tourism, the Department of Culture and Sports, the Department of Tourism; radio and television representatives, regional and local television stations from Thua Thien Hue province onwards; representatives of a number of associations and associations; collective representative organizations of copyright and related rights; representativesof some copyright owners; units exploiting and using copyright and related rights; Some consulting services, practicing lawyers on copyright, related rights and media agencies.
The conference is an opportunity for management and enforcement agencies on copyright and related rights to receive the following contents: Introduction of amendments and supplements in the Draft Decree stipulating administrative sanctions on copyright and related rights (replacing Decree No. 131/2013/ND-CP); exchange, discussion and suggestions from target groups: groups of opinions of representatives of Departments of Culture, Sports and Tourism, Departments of Culture and Sports, Departments of Tourism; opinion groups of legal experts, companies, law offices; group of opinions of intermediary service providers/ units authorized by the right owner; Group of opinions of collective representative organizations of copyright and related rights; opinion groups of broadcasters, radio stations and other opinion groups.
This is also an opportunity for localities to share experiences in the management and enforcement of copyright and related rights; contributing to bringing the law on Intellectual Property into life, contributing to raising awareness and sense of observance of the law on copyright, the right to relate to, promote creative activities and protect creative achievements and develop cultural industries in the spirit of Decision No. 1755/QD-TTg dated September 8, 2016 of the Prime Minister on approving the Strategy for the development of cultural industries of Vietnam, towards the goal of building a healthy and competitive cultural industry, contributing more and more to GDP, creating more jobs and increasing the country’s export turnover.
